What can an authority ask from me?

In simple words

An authority can send a reasoned request. This means a request with a clear reason. You must then give all information and documents that show your product follows the rules. You can send them on paper or electronically, in a language that the authority understands (Article 6(9)). You must also help the authority to remove risks.

Words in this article

Competent national authority
A government body in an EU country that checks if products follow the rules. It is also called a market surveillance authority.
Technical documentation
The set of documents that show the product follows the rules. It includes the product description, the materials, the production process, test reports and the label.
EU declaration of conformity (DoC)
A signed document in which the manufacturer states that the product follows the rules.
Member State
A country that is part of the European Union. There are 27.

What should you have ready?

In practice: the technical documentation, the declaration of conformity, the label or leaflet and the test reports. Depending on the module, also the notified body certificate or the quality system records.

Which language?

The language must be one the authority understands. Prepare translations before the request arrives. Read languages and translation.

What if your product is not compliant?

If you think that a product on the market does not follow the rules, you must act at once. Fix it, withdraw it from the market or recall it. If the product is a risk to people, animals, plants, safety or the environment, tell the authorities of the EU countries where you sold it immediately (Article 6(8)).

Is there a deadline?
